BREAKING NEWS

Update on the Tuccori Proposed Class Action Settlement (as of July 17, 2026)
The biggest development since our last discussion on the Data Advocate is that the settlement has moved beyond a proposed framework into an active, court-authorized settlement administration phase.
- The settlement remains preliminarily approved
The U.S. District Court for the Northern District of Illinois has preliminarily approved the nationwide settlement. This is not yet final approval, but it authorizes the settlement process to move forward while the court evaluates whether to grant final approval.
- Notice has been authorized and claims are now opening
The home purchase must have occurred during the “Class Periods” in order to be eligible for membership in the Settlement Class. The Class Periods vary by state and Defendant.

The official settlement website now states:
- Court-approved notice is being sent to potential class members.
- The claims filing portal opened on July 17, 2026.
- Additional brokerages, franchisors, and real estate companies may still opt into the settlement framework.
This is an important procedural milestone because the settlement is no longer just theoretical—it has entered the claims administration stage.
- Scope of the proposed settlement class
According to the official settlement website, the proposed settlement covers:
Homebuyers who purchased a home listed on an MLS in the United States where a commission was paid to any brokerage in connection with the transaction.
It is described as a first-of-its-kind nationwide class settlement for homebuyer antitrust claims.
All persons who purchased a home that was listed on an MLS anywhere in the United States where a commission was paid to any brokerage in connection with the transaction during the Class Periods.
However, the Settlement Class does not include: persons who submit a valid request to be excluded from the Settlement Class; persons who have separately released the Released Claims against a Settling Defendant in a court approved class settlement in the Burnett, Gibson, Keel, or Hooper matters.

Tuccori et al. v. At World Properties, LLC et al., Case No. 1:24-cv-00150
- NAR’s participation
NAR continues to participate through its announced $52.25 million agreement, which was added through the Tuccori opt-in settlement framework rather than through a separate lawsuit. That agreement still depends on the court’s final approval of the settlement process.
Relationship to Batton
There have also been several procedural developments.
- A federal judge denied an effort by Batton plaintiffs to stop NAR’s Tuccori settlement from moving forward, allowing the approval process to continue for now.
- Courts have also granted stays of portions of the Batton litigation while the Tuccori settlement approval process proceeds. Defendants have argued that continuing litigation while settlements are pending would be inefficient.
This does not mean Batton has been dismissed. Rather, the courts are allowing the Tuccori settlement process to continue before deciding how much of Batton remains to litigate.
What we’ll be watching next

The major events to monitor are:
- Final approval hearing for the Tuccori settlement — set for November 2, 2026.
- Participation rates (how many eligible homebuyers actually submit claims).
- Whether additional defendants opt into the settlement.
- Whether the court ultimately concludes that the settlement adequately resolves claims that overlap with Batton.
- Whether any appeals delay implementation.
More notes:
For avoidance of doubt, the Settlement Class includes persons who purchased a home listed on any MLS, regardless of affiliation with The National Association of Realtors®, including the Real Estate Board of New York, the REBNY Residential Listing Service, the Northwest Multiple Listing Service, West-Penn Multi-List, Inc., and MLS Property Information Network.
The Settlement here does not overlap with any of the existing home seller settlements. Rather, this Settlement resolves the legal claims of homebuyers who were not included in the home seller settlement.
Total Paid into Global Settlement Fund so far is $120,334,500
Large payments include: NAR $52M; Anywhere $9.6M; Hanna Holdings $8.2M; Home Services $30M; eXp $4.3M; Compass $7.3M; Douglas Elliman $2M;

Jenkins at the Everett McKinley Dirksen U.S. Courthouse, 219 South Dearborn Street, Chicago, IL 60604 or via telephone or video conference. At this hearing, the Court will consider whether the Settlement is fair, reasonable, and adequate and decide whether to approve the Settlement, Class Counsel’s attorneys’ fees, expenses, and service awards.
